Whether you're dealing with injuries on property from slip and fall accidents in retail establishments or a homeowner’s collapsed floor or deck, we have the expertise to assist you. These premises liability claims often hinge on whether the dangerous condition was 'open and obvious' and if the property owner knew about it but chose to ignore it.

We can tell you all day how great we are. What matters is what we've done for our clients. Here are some examples in unique premises liability cases involving complex and unique legal issues.
We helped a young woman who came to us 1 day before the statute of limitations expired. She had fallen through the floor of a rental home when the floor collapsed, killing her unborn child. Shockingly, most tenants cannot recover from such an injury because, under Virginia law, they were in exclusive control of the home when the accident occurred. However, we found evidence that the landlord had made a faulty roof repair that caused the floor support to rot out. We convinced the Court to allow the case to go to the jury and it settled a few days before trial for over 30 times what the insurance company had offered her before we got involved!
This was truly a unique case. We helped a family who was delivering groceries to a customer who had already selected and paid for them when a store employee falsely accused them of stealing. In addition to defamation, we convinced the Court to allow us to allege premises liability, as well, because the retailer had failed to tell their employees that people would be picking up items and leaving the store without paying for them. The case settled for 6-figures just before trial after 2 years of litigation. We believe it is the only such premises liability case every allowed to proceed in Virginia.
We had an elderly woman contact us about an incident that occurred inside a major retail establishment. She was walking down the aisle when an employee negligently struck her with a shopping cart. The cart didn't hit her with much force, but it was enough that it knocker her off balance and she fell to the floor. Medical records confirmed bruising and a slight twist of her ankle. The case was resolved quickly for a confidential sum that our client greatly appreciated.
